Regulatory update – Australia

ASIC continues to enhance its digital lodgement process, making it simpler and more flexible for users to manage their filings.

Electronic signatures are now accepted on all ASIC forms, allowing documents to be signed conveniently via phone or tablet. This update improves accessibility and flexibility for all users.

When using an electronic signature instead of a handwritten one, it must either be:

  • Physically signed on a touchscreen device (using a stylus or finger), or
  • An image of the person’s handwritten signature that is digitally inserted.

However, electronic signatures cannot be used on documents attached to ASIC forms if the document is:

  • A certified true copy, or
  • A solemn document (such as an affidavit or statutory declaration) signed in a jurisdiction where electronic signing is not legally permitted.

In response to stakeholder feedback, ASIC has also enabled an additional 12 forms for email lodgement, offering a faster and more convenient submission channel. Paper lodgement remains available for those who prefer the traditional postal option.

More forms are expected to be enabled for email lodgement in the coming months.
